REPORTS OF MUNICIPAL OFFICERS

2013 Proposed Budget Calendar

Report No. 2012.092 (Accounting & Budgets) identifies recommended timelines for the 2013 Budget Calendar. (Pages 61-66)



With respect to Report No. 2012.092 (Accounting & Budgets), we recommend that the dates for Special Committee of the Whole meetings to deliberate the 2013 Capital and Operating Budgets for the City of Thunder Bay be approved in accordance with Attachment 1 - 2013 Budget Calendar.


Earthwise Trademark

Report No. 2012.087 (Environment) recommending that the City of Thunder Bay enter into an agreement with Cambridge and North Dumfries Energy Solutions Inc. to transfer and assign the EarthWiseŽ Trademark to the City, subject to the terms and conditions recommended in this Report. (Distributed Separately)

With respect to Report No. 2012.087 (Environment), we recommend that the City of Thunder Bay enter into an agreement with Cambridge and North Dumfries Energy Solutions Inc. to transfer and assign the EarthWiseŽ Trademark to the City, subject to the terms and conditions recommended in this Report;

AND THAT the purchase of the trademark be funded in accordance with the attached Contract Source of Financing;

AND THAT the Mayor and Clerk be authorized to execute the agreement and any other related documents necessary to finalize the transaction, in form and content satisfactory to Administration and the City Solicitor;

AND THAT any and all necessary by-laws be presented to City Council for ratification.

1. THAT an Independent Engineering Assessment be completed to analyse the flooding of the Water Pollution Control Plant for the purpose of repair and recovery work, and for future action to prevent future plant flooding. This action will proceed in keeping with By-law 113-2011 Emergency Procurement Method for Goods and Services; and

2. THAT Administration prepare a detailed Neighbourhood Master Stormwater Drainage Study for those areas impacted most directly by the declared Flood Disaster; and

3. THAT Administration report the preliminary results of the above noted study in conjunction with the Proposed 2013 Capital Budget & Forecast, as well as through the update of the Pollution Prevention and Control Plan; and

4. THAT Administration be directed to further review and report back in July 2012 on potential options for the City of Thunder Bay related to a Residential Drainage Assistance Program as outlined further in Corporate Report No. 2012.107, with information on how the specific strategies and actions will be implemented, including cost estimates and funding sources.

AND WHEREAS the maximum levy to these institutions under Section 323 of the Municipal Act is $75 per unit capacity, a rate that has been in place since 1987;

AND WHEREAS the rate has remained constant since that time despite the fact that inflation would in 2012 require an almost doubling the payment ($146);

AND WHEREAS the payments in lieu of taxes do not meet the actual costs to the City of providing the necessary services for the various institutions, thus placing an unfair tax burden on other property tax payers, jeopardizing the City's ability to meet infrastructure demands, and weakening our ability to act as an economic engine;

THEREFORE BE IT RESOLVED THAT the City of Thunder Bay calls on the government of the Province of Ontario to include in the 2013 budget an increase to the payments in lieu of taxes, that are an important revenue stream which do not keep up with GDP or inflation, as the per capita or capacity rated payments have not increased since 1987;

AND THAT the per capita and capacity rated payments in lieu be indexed to an appropriate economic statistic such as the consumer price index or the nominal increase in gross domestic product and then adjusted annually;

AND THAT the Municipalities be compensated for the freezing of per capita and capacity rated PILs which has occurred for more than two decades;

AND THAT the City of Thunder Bay calls on the Province of Ontario to meet with the host municipalities for the purpose of reviewing the basis for payments in lieu of taxes, and determining a stable foundation going forward for those payments that meets associated costs prior to the 2013 budget cycle;

AND THAT copies of this resolution be forwarded to the Premier Dalton McGuinty, The Honourable Dwight Duncan, Minister of Finance, The Honourable R. Bartolucci, Minister of Northern Development and Mines, The Honourable Kathleen Wynne, Ministry of Municipal Affairs and Housing, Mr. B. Mauro, MPP – Thunder Bay – Atikokan, Mr. M. Gravelle, MPP – Thunder Bay – Superior North, the Large Urban Mayors Caucus of Ontario (LUMCO), the Eastern Ontario Mayors Committee (EOMC), the Association of Municipalities of Ontario (AMO), the Northwestern Ontario Municipal Association (NOMA), and leaders of the opposition party.
