Official Plan Amendment - Gus Wouri Road

To consider an application to amend the policies of the Official Plan to permit the severance of one additional lot located on the west side of Gus Wouri Road.

Administration is recommending that the Official Plan not be amended, as the application does not promote efficient and cost effective development in the Rural area.

At the March 19, 2012 City Council (Public Meeting) the applicant, supporters and objectors appeared before Council relative to the above noted report. The Deputy City Clerk advised that the resolution as contained in Report No. 2012.043 (Planning) would be presented for consideration at the City Council Meeting on April 23, 2012, in accordance with Section 51(20) of the Planning Act.

At the April 23, 2012 City Council (Public Meeting) Report No. 2012.043 (Planning) - Draft Plan of Subdivision - 1490220 Ontario Ltd. (Ryan Jones) - 1230 Mountain Road, was withdrawn by Administration at the request of the applicant, and will be dealt with at a later date.

Draft Plan of Subdivision

THAT a Public Meeting having been held with respect to the application by 1490220 Ontario Ltd. to create 25 lots for single detached dwellings on

part of the East half of Lot 12, Concession 12, S.K.R., 1214/1230 Mountain Road (58T-09502), draft plan approval be issued, subject to the conditions outlined in APPENDIX "A" to Report No. 2012.043 (Planning);

AND THAT the plan of subdivision proceed to final approval in stages to the satisfaction of the Engineering and Planning Divisions;

AND THAT the necessary By-laws be presented to City Council for ratification;

ALL as contained in Report No. 2012.043 (Planning), as submitted by the Development Services Department.

BY-LAWS

THAT the following By-laws be introduced, read, dealt with individually, engrossed, signed by the Mayor and Clerk, sealed and numbered:

1. A By-law to remove the "H" - holding symbol for the property of the south side of John Street Road at Mercier Street. (1381 John Street Road)

Explanation

: The purpose of this By-law is to remove the "H" - Holding symbol for the property on the south side of John Street Road at Mercier Street. The land is currently zoned "R3-H" - Residential Zone Three - Holding. The effect of removing the holding symbol from the "R3-H" Zone, as it applied to these lands, being a portion of Plan M-547, Part of Lot 31 and Lot 32, is to allow the lands to be developed for a total of four (4) building lots.

2. A By-law to amend By-law 100-2010 (The Zoning By-law) of The Corporation of the City of Thunder Bay. (270 and 272 Algoma Street South)

Explanation

: The purpose of this By-law is to amend By-law 100-2010, as amended, the City of Thunder Bay Zoning By-law, as it applies to 270 and 272 Algoma Street South. Specifically, this By-law will recognize 270 and 272 Algoma Street South as two independent parcels of land that have been inadvertently merged into one lot, as per Regulations in the

Planning Act

. The effect of this rezoning would be to allow each parcel of land to be separately transferable.

Explanation

: The purpose of this By-law is to amend

By-law 100-2010, as amended, the City of Thunder Bay Zoning By-law, as it applies to Part of Lot 29, Concession B, Saving and Excepting Parts 1-3 on Reference Plan 55R-11524, as well as a portion of the West Half Lot 28, Concession B, being Part 2 of Reference Plan 55R-4116, municipally known as 186 Gus Wouri Road, and a portion of the abutting road allowance.
