Ratifying Resolution

Contract 5, 2012 - Asphalt Surface Rehabilitation 2

Report No. 2012.081 (Engineering) recommending that Contract No. 5, 2012 for Asphalt Surface Rehabilitation 2 be awarded to Bruno’s Contracting (Thunder Bay) Limited who submitted the lowest tender.

Pending the passage of the resolution relative to the above-noted at the Committee of the Whole meeting, to be held earlier in the evening, the resolution will be presented for ratification and under Council's policy will require a two-thirds vote.

With respect to Report No. 2012.081 (Engineering), we recommend that Contract No. 5, 2012 for Asphalt Surface Rehabilitation 2 be awarded to Bruno’s Contracting (Thunder Bay) Limited who submitted the lowest tender in the amount of $2,658,006.45 (inclusive of HST); it being noted that the amount shown is based on estimated quantities; final payment for this contract will be based on measured quantities for the completed work;

AND THAT the work will be funded in accordance with the Source of Financing form attached to this Report;

AND THAT the General Manager of Infrastructure and Operations report any circumstances to City Council should any serious variations in the contract quantities occur as work proceeds;

AND THAT the Mayor and City Clerk be authorized to sign all documentation related to these matters;

AND THAT any necessary By-law be presented to City Council for ratification.

BY-LAWS

THAT the following By-laws be introduced, read, dealt with individually, engrossed, signed by the Mayor and Clerk, sealed and numbered:

A By-law to permit the hunting of deer by means of bow and arrow in certain areas of the City of Thunder Bay.

Explanation

: Council considers it appropriate to permit the hunting of deer by means of bow and arrow in certain areas within the City of Thunder Bay. Excessive deer populations contribute to the destruction of private property, to the unpredictable and aggressive behaviour of deer, and increases the opportunity for motor vehicle collisions involving deer, and the spread of infectious diseases among deer and wildlife and human beings.

2. A By-law to authorize curb and gutter on West Amelia Street on Petition under the provisions of the Municipal Act, 2001.

Explanation

: The purpose of this by-law is to authorize curb and gutter work on West Amelia Street.

3. A By-law to authorize curb and gutter on Montreal Street from approximately 320m along Bombardier property frontage as a Local Improvement on Petition under the provisions of the Municipal Act, 2001.

Explanation

: The purpose of this By-law is to authorize curb and gutter on Montreal Street via Local Improvement on Montreal Street from approximately 320m along Bombardier property frontage.

4. A By-law to amend By-law Number 100-2010 (The Zoning By-law) of The Corporation of the City of Thunder Bay (Dawson Heights Stage 4 Subdivision).

Explanation

: The purpose of this By-law is to amend By-law 100-2010, as amended, the City of Thunder Bay Zoning By-law, as it applies to Part of Mining Location R3 described as Parts 1, 2, 3, and 4 on RP 55R-10449, Part 2 on RP 55R-8139, and Part 1 on RP 55R-8139 except Part 1 on RP 55R-9814. Specifically, this By-law will amend the Zoning By-law to rezone a portion of the lands from the "R5" – Residential Future ZONE to "R1-H" – Residential One ZONE – Holding, MU2-H" – Mixed Use ZONE Two – Holding, and "OS-H" – Open Space ZONE – Holding.
