With respect to Report No. 2011CLS.032 (Realty Services), we recommend that the properties and easement interests described in this Report be declared surplus to the City's requirements pursuant to the City’s policies, and be disposed of in accordance with the methods set out in this Report;

AND THAT public notice of the proposed disposals be given in the manner set out in Report No 2011CLS.032;

AND THAT the City's interest in the vacant lands (A74) described as Part of Park Lot 1, Town Plot of Fort William, Designated as Part 2 on Reference Plan 55R-2200, be sold to the abutting property owner of 730 South Syndicate Avenue (Willhac Inc.) for lot enlargement purposes at the appraised market value ($9,234.00);

AND THAT a portion of the City’s easement interest in the property municipally known as 101 Spruce Court, described as Lot 3, Plan M-119, (B13), be released;

AND THAT the City's interest in the untravelled portion of Wiegand Avenue (C154) adjacent to Lot 50 and 62 and Part of Lane, Registered Plan W426, municipally known as 493 and 601 North Marks St., (once closed) be sold on the open market at fair market value;

AND THAT the City's interest in the Lane (D42) abutting Lots 10 to 22 and Lots 200 to 212, Registered Plan M-37, municipally known as 19 - 43 Picton Avenue and 18 - 42 Junot Avenue, be sold (once closed) to the abutting property owners for lot enlargement purposes at the appraised market value;

AND THAT the City's interest in the vacant property being a portion of Lot 14, Block A, Registered Plan 579, municipally known as 211 Elgin Street (E62), be sold on the open market at fair market value;

AND THAT the City's interest in the vacant property described as Block 65, Registered Plan 55M-618 (G22), being the 1 foot reserve south of Weiler Boulevard on the north side of the property known as 101 Reindeer Avenue, be sold to the abutting property owner of 101 Reindeer Avenue (Gordon Furoy) for lot enlargement and access purposes at fair market value;

AND THAT the Mayor and Clerk be authorized to execute all required documentation in form and content satisfactory to the City Solicitor;

AND THAT any necessary by-laws be presented to Council for ratification.

THAT the resolution relative to Report No. 2011CLS.032 (Realty Services) – Surplus Real Property Declaration – 6 Locations, be amended by deleting the third paragraph "AND THAT the City’s interest in the vacant lands (A74) described as Part of Park Lot 1, Town Plot of Fort William, Designated as Part 2 on Reference Plan 55R-2200, be sold to the abutting property owner of 730 South Syndicate Avenue (Willhac Inc.) for lot enlargement purposes at the appraised market value ($9,234.00);”

AND THAT it be replaced with “AND THAT the City’s interest in the vacant lands (A74) described as Part of Park Lot 1, Town Plot of Fort William, Designated as Part 2 on Reference Plan 55R-2200, be sold to the abutting property owner of 730 South Syndicate Avenue (Willhac Inc.) for lot enlargement purposes at the appraised market value ($4,925.00);"

With respect to Report No. 2011.172 (Licensing & Enforcement), we recommend that Administration prepare a by-law prohibiting the feeding of deer in the City of Thunder Bay;
AND THAT the Discharge of Firearms By-law be amended to permit a controlled bow hunt for deer under certain circumstances and within certain areas of the City, as outlined in this Report;

AND THAT prior to the 2012 hunting season, sufficient information be made available to the public concerning the new hunting rules;

AND THAT the Thunder Bay Police and Ontario Provincial Police be requested to maintain motor vehicle accident statistics related to deer within the City of Thunder Bay

AND THAT any necessary by-laws be presented to City Council for ratification.

"AND THAT the feeding of deer be permitted only on private lands on Mission and McKellar Islands, as outlined in Councillor L. Hebert's memorandum, dated June 15, 2012."

With respect to Report No. 2012.102 (Office of the City Clerk), and following upon the declaration of Thunder Bay and area as a ‘disaster area’ for the purposes of the Ontario Disaster Relief Assistance Program (ODRAP), we recommend that the following individuals be appointed to the Disaster Relief Committee:
Eight voting members to serve as representatives for the City of Thunder Bay, as follows:

1. Gloria Cyr
2. Marv Detweiler
3. Mary Lucas
4. Wayne Fletcher
5. Vince Mirabelli
6. Lynn Peterson
7. Sue Prodaniuk
8. Beverley Ann Sabourin

Two voting members to serve as representatives for each of the Municipality of Oliver Paipoonge and Township of Conmee, as designated by their respective Councils;

AND THAT pending the outcome of the funding agreements, two non-voting member positions be provided to serve as representatives of each of the following:

1. Canadian Red Cross;
2. Salvation Army;

AND THAT the Mayor and Clerk be authorized to execute the Provincial Funding Agreement for ODRAP, as approved in form and content by the City Solicitor, and any other related documentation;

AND THAT any necessary by-laws be presented to City Council for ratification.

"AND THAT two voting member positions be provided to serve as representatives of each of the following:

1. Canadian Red Cross
2. Salvation Army"

1. A By-law to amend By-law Number 139-1997 being a By-law to appoint Inspectors for the purposes of Section 223.1 of the Municipal Act regarding site alteration.

Explanation: To update officers designated to enforce By-law 139-1997.

5. A By-law to amend By-law 060-2012, being a by-law to establish the Thunder Bay and Area Disaster Relief Committee.

Explanation: A By-law to amend By-law 060-2012, being a by-law to establish the Thunder Bay and Area Disaster Relief Committee. This amendment will allow representatives of the Canadian Red Cross Society and the Salvation Army to sit as Full Voting Members on the Disaster Relief Committee.

BY-LAW NUMBER: 072 - 2012


6. A By-law to remove a Holding Symbol pursuant to Section 36 of the Planning Act R.S.O. 1990, as amended (portion of 1055 Oliver Road)

Explanation: The purpose of this By-law is to remove the H - Holding Symbol from a portion of Part of the Northwest Quarter of Section 50, Lot 1503, Registered Plan M40, municipally known as 1055 Oliver Road. The land is currently zoned "OS-H" - Open Space Zone - Holding. Removing the holding symbol (H) from the "OS-H" Zone, as it applies to these lands, will allow the development of a mixed use building containing dwelling units on a new parcel of land on the property.

The Holding Symbol was set to limit development until a Record of Site Condition and an Archeological Assessment are completed and submitted. These have been submitted and completed to the satisfaction of the Planning Division.

7. A By-law to amend By-law 065-2011 being a By-law to Regulate Traffic on the Roads and Highways of The City of Thunder Bay with respect to Schedule "Thirteen" - Increased and Decreased Speed Limits

Explanation: The purpose of this By-law is to amend By-law 065-2011 - Schedule "Thirteen" - Increased and Decreased Speed Limits - specifically the addition of a school safety zone on the Edward Street Corridor between Churchill Drive and Parkway Drive

Explanation: The purpose of this By-law is to close portions of Chilton Avenue, Willard Avenue, Neebing Avenue and the remainder of Sifton Avenue, Plan W-180 and Parts of Lane, Plan W-180, City of Thunder Bay, District of Thunder Bay

BY-LAW NUMBER: 077 - 2012

1. A By-law to confirm the proceedings of a meeting of Council, this 23rd day of July, 2012.

Explanation: To confirm the proceedings and each motion, resolution and other action passed or taken by the Council at this meeting is, except where prior approval of the Ontario Municipal Board is required, adopted, ratified and confirmed as if all such proceedings had been expressly embodied in this By-law.
