Appendix "A" – Draft Approval Conditions for File 58T-09502
(a) For Lots 6, 7, 20, and 21, notice that the Parks Division may construct a local trail system through Blocks 30 and 31.
(b) i) For lots 6, 7, 20, and 21, notice that a permit from the Lakehead Region Conservation Authority is required prior to the issuance of a Building Permit.
ii) For lots 13 and 14, notice that a permit from the Lakehead Region Conservation Authority is required prior to the issuance of a Building Permit due the proximity of the talus slope of Mt. McRae.
(c) For all lots, notice that the adjacent street allowance to Lot 24 has been identified as a potential location for a community mailbox.
(d) For all lots, notice that the area of the subdivision is located within a peregrine Falcon Habitat, which is protected under the Endangered Species Act and that prior to the issuance of any building permit confirmation is to be received from the Ministry of Natural Resources that construction may proceed in compliance with the species protection and habitat protection sections of the Endangered Species Act.
(e) For Lots 12, 13, and 14, notice that the portions of the lots within 250 metres of the cliff face of Mount McRae, that no buildings, structures, or removal of vegetation is permitted.
(f) For Lots 12, 13, and 14, notice that the portions of the lots within 250 and 260 metres of the cliff face of Mount McRae that no construction is permitted between March 1 and August 31.
(g) Any occupancy or utilisation of lands within 250 metres of the cliff face of Mount McRae must be non-structural and with the protection of the natural vegetation in this area
(h) For Lots 15 to 23, notice errant golf balls may from time to time stray onto their Lot and that such Lot owners accept this situation as a risk that such Lot owner will inherit as a property owner adjacent to a golf course.
(i) For Lots 15 to 23, notice that a 6.0 metre wide treed buffer zone will be left in place or planted along the west lot line of these particular lots by the Developer and the owners from time to time of those Lots shall maintain this treed buffer zone so as to reduce the intrusion the errant golf balls onto their particular lot. 12. That prior to final approval, the owner shall satisfy the City Engineer with respect to servicing the subdivision and providing all required easements. 13. That the Subdivision Agreement between the City and the owner contain a provision wherein the owner agrees to stop all work and notify the Ministry of Citizenship, Culture and Recreation in the event that cultural heritage values are uncovered during construction. 14. That the Subdivision Agreement between the City and the owner contain a provision wherein the owner agrees to stop all work and notify the Police, Ministry of Citizenship, Culture and Recreation, and the Registrar of Cemeteries - Ministry of Government Services in the event human remains are uncovered during construction. 15. That prior to final approval, the owner shall enter into an agreement with Thunder Bay Hydro Electricity Distribution Inc. for the costs of supplying electricity service to the development and that the City is to be advised in writing, by Thunder Bay Hydro Electricity Distribution Inc. how this condition has been met. 16. That prior to final approval, the owner shall enter into an agreement with Thunder Bay Telephone for the provision of telephone service to the development and that the City is to be advised in writing, by Thunder Bay Telephone how this condition has been met. 17. That prior to final approval, the owner shall satisfy the City Engineer that the applicable requirements of the Environmental Assessment Act have been met. 18. That prior to final approval, the Subdivision Agreement be registered against the title of the lands to which it applies. 19. Any road construction within the project area must be conducted between August 30 and March 1. 15. That prior to final approval, the owner shall complete a soils analysis to the satisfaction of the Thunder Bay District Health Unit and that the City is to be advised in writing, by the Thunder Bay District Health Unit how this condition has been met.
