Draft Approval Conditions for File 58T-11502


DRAFT APPROVAL CONDITIONS FOR 58T-11502:

1. That this approval applies to the draft plan prepared by J.D. Barnes Ltd., dated June 28, 2012, which shows a total of 59 lots for single detached dwellings (Lots 1 to 59), two Blocks for walkways (Blocks 60 and 61) and four Streets.

2. That Blocks 60 to 70 be conveyed to the City of Thunder Bay.

3. That the streets be shown and dedicated as public highways on the final plan.

4. That the streets be named to the satisfaction of the Planning Division.

5. That the owner satisfy itself that all lots conform to the requirements of By-law 100-2010, as amended, and that prior to final approval, the amending Official Plan and Zoning By-law, as it relates to this subdivision, is final.

6. That the owner enter into a General Subdivision Agreement satisfactory to the City of Thunder Bay to satisfy all the requirements, financial and otherwise, concerning the provision of roads, stormwater management, installation of services and drainage.

7. That prior to final approval of any subsequent stage of this subdivision, the applicant shall enter into an Addendum to the General Subdivision Agreement satisfactory to the City of Thunder Bay to satisfy all requirements, financial and otherwise, concerning the provision of roads, installation of services and drainage for the proposed stage.

8. That the Subdivision Agreement between the City and the owner contain a provision wherein the owner agrees to plant trees in Silvertree Park to the satisfaction of the Parks Division.

9. That easements as may be required for utility or drainage purposes shall be granted to the appropriate authority.

10. That prior to final approval, the owner shall prepare a lot grading, drainage, and stormwater management plan which is satisfactory to the City Engineer.

11. That the Subdivision Agreement between the City and the owner contain a provision wherein the owner agrees to include in all offers of purchase and sale the following notices:

12. That prior to final approval, the owner shall satisfy the City Engineer with respect to servicing the subdivision and providing all required easements.

13. That prior to final approval, the owner shall enter into an agreement with Thunder Bay Hydro Electricity Distribution Inc. for the costs of supplying electricity service to the development and that the City is to be advised in writing, by Thunder Bay Hydro Electricity Distribution Inc. how this condition has been satisfied.

14. That prior to final approval, the owner shall enter into an agreement with Thunder Bay Telephone for the provision of telephone service to the development and that the City is to be advised in writing, by Thunder Bay Telephone how this condition has been satisfied.

15. That prior to final approval, the owner shall satisfy the City Engineer that the applicable requirements of the Environmental Assessment Act have been met.

16. That prior to final approval, the Subdivision Agreement be registered against the title of the lands to which it applies.

17. That the Subdivision Agreement between the City and the owner contain a provision wherein the owner agrees to construct a chain link fence at the rear of lots 48 - 54 and along Blocks 60 and 61 to the satisfaction of the City Engineer and Manager of the Parks Division.

18. That the Subdivision Agreement between the City and the owner contain a provision wherein the owner agrees to stop all work and notify the Ministry of Citizenship, Culture and Recreation in the event that cultural heritage values are uncovered during construction.

19. That the Subdivision Agreement between the City and the owner contain a provision wherein the owner agrees to stop all work and notify the Police, Ministry of Citizenship, Culture and Recreation, and the Registrar of Cemeteries - Ministry of Government Services in the event human remains are uncovered during construction.

20. That the Subdivision Agreement between the City and the owner contain a provision wherein the owner agrees to provide curb depressions for Community Mailboxes adjacent to lots 13 and 54 within the street allowance to the satisfaction of Canada Post.

21. That prior to final approval, the owner conduct a review of the storm water sewer system for the entire Dawson Heights Community Plan area to confirm that the existing design conforms to the City of Thunder Bay's current Engineering and Development Standards.

22. That prior to final approval, the owner pay to the City of Thunder Bay, to the satisfaction of the City Engineer, $68,929 for this development's portion of the costs associated with the installed oversized water mains and deeper sewers on Hilldale Road.
